These Terms of Service (“Terms”) govern your access to and use of the services provided by Road Runner Transport (“Company,” “we,” “our,” or “us”), including septic installation, excavation services, and related offerings (collectively, the “Service”). By engaging with our services, visiting our website, or entering into any agreements with us, you agree to comply with and be bound by these Terms. If you do not agree, you must refrain from using our services.

1. Acceptance of Terms

By requesting or using our services, you confirm that you have read, understood, and agree to these Terms. Road Runner Transport reserves the right to update or modify these Terms at any time. Changes take effect upon posting on our website. Continued use of our services after modifications constitutes acceptance of the revised Terms.

2. Scope of Services

Road Runner Transport provides professional services, including but not limited to:

  • Septic System Installation and Maintenance
  • Excavation Services for Residential and Commercial Projects
  • Land Grading and Clearing
  • Drainage Solutions and Trenches
  • Foundation Digging

All services comply with industry standards and local regulations. Clients (“you”) are responsible for securing necessary permits unless otherwise agreed in writing.

3. Estimates, Contracts, and Payments

  • Estimates & Quotes: Subject to change based on unforeseen conditions or client modifications. Final prices are outlined in the service contract.
  • Contracts: A signed contract is required before work begins, detailing scope, timeline, payment terms, and responsibilities.
  • Payments: Due as per the contract. Late payments may incur interest charges and could lead to service suspension or termination.

4. Site Conditions and Responsibilities

  • Site Preparation: Clients must ensure the site is clear of obstructions (vehicles, equipment, debris) before work begins.
  • Access: Clients must provide safe and adequate site access. Delays caused by restricted access may incur additional charges.
  • Utility Marking: Clients must ensure underground utilities (gas, water, electrical) are properly marked. Road Runner Transport is not liable for damages to unmarked utilities.

5. Warranties and Guarantees

We guarantee workmanship for a specified period (detailed in individual contracts). This warranty excludes damage caused by:

  • Improper maintenance or negligence
  • Unauthorized repairs or modifications
  • Natural disasters (e.g., floods, earthquakes)
  • Pre-existing site conditions undisclosed before project commencement

6. Limitations of Liability

To the fullest extent permitted by law, Road Runner Transport is not liable for:

  • Property damage arising from excavation or septic installation
  • Personal injury on the worksite
  • Business losses or project delays
  • Environmental damage

Total liability is limited to the amount paid by the client for the specific service provided.

7. Client Responsibilities and Indemnification

You agree to indemnify and hold harmless Road Runner Transport from claims, losses, or liabilities resulting from:

  • Failure to secure necessary permits
  • Inaccurate or incomplete site information
  • Damage due to unmarked utilities
  • Third-party claims related to the site or project

8. Delays and Force Majeure

We strive to meet deadlines but are not responsible for delays caused by:

  • Severe weather
  • Unforeseen site conditions (e.g., rocky soil, hazardous materials)
  • Regulatory or permitting issues
  • Third-party disruptions
  • Natural disasters or force majeure events

In case of delays, we will communicate promptly and adjust timelines as necessary.

9. Termination

Either party may terminate the contract with written notice. If you terminate, you are responsible for payment for services rendered up to the termination date, including any demobilization costs.

Road Runner Transport may suspend or terminate services for non-compliance with these Terms, late payments, or failure to meet contract obligations.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario. Any disputes will be handled exclusively in the courts of Ottawa, Ontario.

11. Changes to the Terms

We may modify these Terms at any time. Updates take effect immediately upon posting. Continued service use after updates implies acceptance.
